Caroline Traffic Attorney: Reckless Driving, Speeding, And DUI

Caroline County Reckless Driving Speeding Traffic Attorney

Caroline County Virginia Reckless Driving Speeding Lawyer

Caroline County, Virginia has become famous for issuing traffic tickets. Importantly, in Caroline we see a lot of reckless driving and speeding traffic tickets.  Moreover, if you have received one of these violations, contact Caroline traffic attorney Trey Mattox.

Primarily, there are two main roads in Caroline County. As such, drivers often find themselves being pulled by police officers on both Interstate 95 and Route 301. Notably, these are high traffic sections of road for both commuter and interstate traffic.

However, Caroline County is a more rural area of the state. Therefore, we see speed limits of 70 mph along Interstate 95 here. Additionally, there is much less traffic as compared to the bigger cities in Virginia. Therefore, the flow of traffic is often much greater through here. As such, it is easy to receive a Caroline traffic ticket for speeding or reckless driving while traveling with the flow of traffic.

Most importantly, Mattox Law has represented clients facing Caroline traffic tickets such as reckless driving and speeding throughout the county. For instance, some of these localities include Bowling Green, Lake Caroline, Ruther Glen, Lake Land’Or, Port Royal, and surrounding areas.

DUI Representation

A DUI conviction in Virginia carries very extreme consequences. As such, a DUI can often lead to time in jail.  DUI or driving under the influence can be applied to both drug and alcohol cases. Additionally, there is no categorical difference in Virginia in between DUI v. DWI. However, the offense is most frequently referred to as a DUI. Similar to reckless driving, a first offense DUI charge in Virginia is a class 1 misdemeanor. Therefore, a DUI carries a maximum $2,500 fine, 12 month license suspension, and 12 months jail sentence.

Moreover, there are mandatory minimum sentences for some DUI cases. A mandatory minimum sentence must be enforced upon conviction of an elevated BAC DUI.  A DUI can become elevated due to the defendants blood alcohol content (BAC) or previous DUI convictions.  There are too many scenarios to list here, but I would invite you to contact me so that we can discuss your case and how these factors apply to your DUI case.

Trey analyzes each DUI case with extreme care in order to ensure all possible defenses are used at trial. This careful analysis can become important at trial and during negotiations with the prosecutor.  There are often questionable situations in a DUI case. At times, these may not be significant enough to lead to a dismissal. That said, these situations can be used as leverage for a better plea agreement.  It is extremely important to contact an Caroline traffic attorney who is willing to spend the time to go over every detail. Moreover, this will ensure we get the best possible result for your DUI case.

Defending Speeding Cases

Speeding traffic tickets in Virginia can vary significantly depending on the nature of the offense.  Notably, the most severe cases are often charged as reckless driving by speed. This designation elevates the offense from a simple traffic ticket to a class 1 misdemeanor.  Although speeding is an infraction rather than a misdemeanor, a conviction can still carry very serious consequences.  As such, this Caroline traffic ticket conviction can lead to points on your driving record, license suspension, high fines, and increased insurance rates.

Caroline traffic attorney Trey Mattox has represented thousands of individuals charged with speeding infractions. Further, Trey has an outstanding record of having these speeding traffic tickets reduced or dismissed.  When contesting speeding tickets, Trey regularly saves Mattox Law clients hundreds of dollars in fines and insurance premiums. More, we are able to preserve your driving privileges.  Trey is intimately familiar with Caroline speeding traffic ticket laws. He knows what is required of the officer ensuring that all possible legal strategies are pursued.

What is Reckless Driving?

There are many varieties of reckless driving  in Virginia. The most prevalent is Virginia Code § 46.2-862 Exceeding speed limit.  The reckless driving VA code states:

Classification and Penalties

Expected Outcomes

Each Caroline traffic ticket case is unique, whether speeding or reckless driving. They all carry individual issues leading to a variety of potential results. Notably, the biggest factor affecting the outcome of a case is the original traffic ticket received or allegation. Certainly, we expect far different outcomes for DUI or reckless driving charges as compared to speeding traffic tickets.

However, there are many other factors that can affect potential results involved with every Caroline traffic case. One of the most important factors the court will take into consideration is your demeanor with the police officer. Obviously, the judge will be far more lenient to an individual who is polite and cooperative as opposed to argumentative or uncooperative.

Another major factor is the number of prior speeding violations and points on your driving record. Namely, most judges and commonwealth’s attorneys are unwilling agree to a favorable outcome without viewing your driving record. Clearly, a clean driving record will allow for much better results for your Caroline traffic ticket than one with multiple prior speeding, reckless driving, or other traffic violations.

Driving School for Dismissal

Driving school is a very powerful tool in the defense of Caroline traffic tickets. Whereas, in many cases I will advise my clients to complete driving school before the court date. In other cases, the judge may require you to complete driving school. Under those circumstances, it is up to you to get the driving school completed by the deadline set by the court.

In many cases, judges will issue driving school for your first traffic ticket. Thereafter, they are less willing to allow driving school for subsequent tickets. Of course, courts and judges differ from jurisdiction to jurisdiction. As such, some judges are more lenient in this regard. In most cases, the court will allow you to complete driving school online or in person as long as the hour requirement is met.

To comply with the courts order you must submit the original certificate of completion by the deadline. In addition to the certificate, you will be required to pay court costs which can vary.

Driving School for Reduction

In some cases the speed may be too high, or there may be too many prior violations for the court to be willing to dismiss your Caroline traffic ticket. In those situations, the court may still require driving school to reduce the charge.

There are a couple different routes the court may go in regard to the reduction of your Caroline traffic ticket. The most common and likely scenario would be a reduction to a simple speeding violation. As well as that, another common outcome would be the reduction to improper driving. In other circumstances, the court may be willing to reduce the original Caroline traffic violation to some sort of non-moving violation. Moreover, common non-moving violations include defective equipment, defective speedometer, or failure to obey a highway sign while sleeping.

There are also situations where the court will not reduce the speed, but they will amend the reckless driving code section to simple speeding. Therefore, under that scenario the misdemeanor would be dropped. However, you would still likely get the same amount of points on your record. Finally, there are some instances where the court is unwilling to reduce the violation. That said, the court will waive an active jail sentence and/or license suspension upon the completion of a defensive driving course.

Defective Equipment

Defective equipment is a violation you may receive for having a tail light out or maybe a cracked windshield. This is a non-moving violation typically indicating that something may have been wrong with your vehicle as opposed to your driving. As a non-moving violation, defective equipment does not carry any points on your driving record.

Many judges in Virginia use defective equipment as a means to reduce a Caroline traffic violation that otherwise would carry points on your driving record. Typically, this is used as a reward for those folks with good driving records. Additionally, defective equipment is reserved for those folks charged with less egregious violations. Moreover, this outcome allows the judge to reward someone with a good record by keeping points off the record. However, this reduction also allows the judge to still issue a fine.

A reduction to defective equipment is often a bit of a quid pro quo allowing judges to reduce moving violations while still allowing him to collect a fine. In many cases, the judge will keep the fine at the standard based on the originally charged speed. In other cases, the judge may enhance the fine for having a few priors on your record. Finally, demeanor issues with the officer can also cause the judge to enhance the fine.

Speeding Infraction

For some Caroline traffic cases, avoiding any points or having the case dismissed may not always be possible. In those cases, our focus will often shift to reducing points going on your driving record and avoiding the misdemeanor conviction. Reckless driving is a class 1 misdemeanor. Therefore, we need to ensure that you are not convicted of reckless driving to prevent you from having a criminal record. One option for the court to reduce a reckless driving charge is speeding.

Simple speeding is just a traffic infraction and therefore will avoid the misdemeanor conviction. Additionally, most state’s DMV point systems are based on speed. Moreover, points are based on mph over the speed limit for a speeding violation. Therefore, convincing the court to reduce the speed should reduce the points going on your record. This reduction in points can then have several secondary consequences as well.

In some states, a speeding conviction over a certainly threshold, such as 15 mph over the speed limit, can lead to an automatic license suspension. By reducing the speed, we can ensure that your license is not administratively suspended. Additionally, a reduction in speed will also help to ensure that insurance rates are not effected. Most insurance companies will use mph over the speed limit as part of their analysis. Therefore, the lower the speed the less likely your insurance will be affected by the Caroline traffic case.

Improper Driving

Improper driving is a frequently used reduction specific to reckless driving cases. Moreover, I find improper driving is most frequently used in accident related cases. That said, it is certainly used in reckless driving by speed cases as well.

Many judges and commonwealth’s attorneys prefer improper driving because it allows them to issue an elevated fine of $500.00. In contrast, the maximum fine for a simple speeding conviction of $250.00. However, improper driving only stays on a Virginia record for 3 years. In contrast, speeding stays on your record for 5 years and 11 years for reckless driving.

An improper driving reduction will accomplish the primary goals of reckless driving representation. First, it will avoid the class 1 misdemeanor conviction. Second, this will reduce the number of points on your record. Improper driving, similar to a simple speeding violation, is just a traffic ticket infraction. Thus, this will not appear on your criminal record. Additionally, on a Virginia driving record, improper driving will cut the points in half from a 6 to 3. Of course, this will help to keep your insurance from being affected.

Unfortunately, there are certain cases that, despite our best efforts, result in a conviction of the your Caroline traffic violation. Certainly, in most cases our number one goal is to avoid a conviction for the alleged Caroline traffic offense. However, in some cases it is improbable or nearly impossible to get the charge reduced. These cases can be difficult to reduce for a number of reasons. Some of the main reasons include the nature of the alleged offense, the underlying facts, and your prior record. In these situations, we are hoping to convince the court to reduce the consequences of a conviction. Namely these consequences include a fine, license suspension, and jail sentence.

Reckless Driving Reduced

I contacted Mr. Mattox’s office after I received a reckless speeding ticket in Hanover County on my way back to DC (87MPH in a 55MPH zone). After talking to multiple lawyers, Mr. Mattox, while reassuring, was also the most honest in laying out the likely outcomes of the case. Because I already had had two previous speeding tickets, I was facing a license suspension and potentially jail time. But Mr. Mattox and his case manager Stephanie were very professional and laid out multiple steps to follow ahead of my court date to put me in the best position. Because I completed the steps Mr. Mattox laid out, he was able to persuade the judge to drop my Reckless Driving by speed (which is a misdemeanor) to Improper Driving with no license suspension or jail time, only a $350 fine. The judge even said at the very end that the only reason that I was “walking out the front door today” was because my lawyer “made a very convincing argument.” Mr. Mattox did a great job and I plan on recommending him to any of my family or friends who have traffic cases in central Virginia.

Hire Him!

Trey and his staff are super professional, and they helped me with every step along the way. I was charged with reckless driving by speed in Mecklenburg County, 95/70. I am from South Carolina and was traveling through, so I had no idea that the penalties were so stiff for speeding in Virginia. I was not able to travel back to Virginia for court, so Mr. Mattox appeared on my behalf and did an exceptional job. Trey was able to get my charge reduced to improper driving, which was a great result in my opinion. He saved me a lot of headache. I was very worried that I would get convicted and have my insurance skyrocket and have a criminal record, but Trey was able to get it reduced! I am super thankful I chose him. I am now able to move on with my life without a criminal record. Thank you again Trey and Stephanie, you guys are the best!

Reckless Driving to Non Moving

In June 2019, my son was coming back from school in NC and got caught doing 84 in 70 on Rt. 85. He was charged for reckless driving. This ticket worried us because he had two other moving violations in the last year. Mr. Mattox quickly gave us a list of things my son needed to do before the trial date including speedometer calibration check and online course To ease our worries, he told us we did not need to be there in person as we live in DC area. He’s very organized and very responsive throughout the process. Trey took time we needed to talk us through it. Stephanie was great too! Our case outcome was better than expected – reduced to non-moving violation! I’d recommend spending the money to get proper representation, especially when looking at a criminal misdemeanor charge – you don’t want that on your record!

Reckless Driving Reduced Down to Speeding

Recently, I got a 92/70 reckless driving ticket in Mecklenburg County. I consulted many attorneys and most of them told me it is impossible to get the reduction down because 92 was too high for the judge to change his mind. I felt hopeless. However, Mr. Mattox showed his confidence and his professionalism, he even answered my endless questions before I hired him. He was patient enough to explain the solution of my case to me, and I ended up with 79/70 speeding! I really appreciate Mr. Mattox and his office manager, Ms. Mosson’s assistance throughout the whole process. Highly recommend this attorney!

Mr. Mattox is Official!

I got a reckless driving ticket (85/55) on I-95 on my wedding night. To my surprise in the Commonwealth, that’s a Class 1 misdemeanor. Oh God! I found this out a week before my case. Stephanie informed me of all things to do on my end (speedometer calibration, RADEP class, etc.) and was very helpful in that process. After a few continuances to get myself together, got a better result than what was told to me during initial consultation. DISMISSED! Have trouble, call MATTOX!

Driving Ticket

I was brand new to the Richmond area and got a traffic ticket late at night. I called Mr. Mattox’s office right away and got a call back the next morning.

He and his staff were super helpful and very clear and concise on what I needed to do before trial and what to expect (i.e. where to look up my driving record) and taking the driving defense course before going to court.

On the day of the trial, Mr. Mattox was in control of the situation at court and told me his game plan along with what the worst possible outcome could be so I was prepared. His preparation paid off, and I got the charged dropped.

Consummate Professional

New to Virginia, I was suspicious of all of the lawyer solicitations I received after being speed trapped. I looked through the dozens of pieces of mail and picked the two I felt seemed most professional, called their offices and assessed each experience.

Trey and staff presented themselves as consummate professionals throughout. My questions were answered quickly and thoughtfully. Those of us new to the Commonwealth need to understand how much local municipalities rely on this income. I travel globally, so had no way of appearing personally in court. Hiring Trey to represent me turned out to be a brilliant strategy. He understands the system and represents you with great professionalism.

Don’t hesitate. Hire him!

Obtained Favorable Outcome for Me!

Early in the morning on Oct. 5, 2017, I was returning to Maryland from having attended the funeral of my best friend in NC. I had just entered Virginia when I was pulled over and informed that I was clocked driving 12 mph over the speed limit. I was shocked because my Garmin Nuvi indicated I was driving 77-78 mph. I signed the summons and continued on my way. Later that night, I looked at the summons and became extremely unraveled – the summons cited me for Reckless Driving! I did an internet search on reckless driving in Virginia and definitely became “unglued!” I immediately googled Emporia, VA reckless driving attorneys and decided on Trey Mattox. I sent him an email that night citing the facts. The next day I received a reply from him, and it was his assurance and knowledge of the Greensville County court system that assuaged my emotions. I agreed to allow him to represent me and emailed him relevant documents. I received an email from him the day following my court case, and he had gotten my charge reduced to faulty equipment! Reckless Driving is as serious an offense as DWI, so I highly recommend anyone facing that charge to hire an attorney — and, Trey Mattox gets my vote!

Mattox Law – Traffic Court Review

While traveling through the Commonwealth of Virginia this summer, I was pulled over and ticketed for doing 81 in a 70 MPH zone. At the time the officer was writing the ticket, I didn’t think I was in too much trouble. After all, in my state, doing 11 MPH over the limit doesn’t usually warrant a second look from an officer at a speed trap. However, upon further inspection of my ticket, I learned that I was in much more trouble. Even though I was only going 11 MPH over the posted speed limit, in Virginia, driving over 80 MPH is considered Reckless Driving – an offense serious enough to land jail time, and basically the equivalent of a DUI in most states.

I immediately started searching online for legal representation and, after visiting several lawyer’s websites and bios, came across some positive reviews for Mattox Law. His success rate for my specific case was appealing, and I found his website informative and helpful. That was enough for me to choose Mattox Law to represent me.

The Mattox Law staff were attentive, knowledgeable, and prompt

Mr. Mattox represented me in court, and successfully negotiated a significantly reduced sentence of Defective Equipment Generally, a non-moving violation with no points and a nominal fine.

Mr. Mattox is a Man of His Word!

I received a ticket for reckless driving in the state of Virginia, doing 85 MPH. Never had a ticket in my life before. Had no idea on how to go about obtaining a lawyer to represent my case. Received letters in the mail from numerous lawyers that were offering their services to take on my case. I chose Mr. Mattox because his letter was simple and to the point. Somehow stood out from the rest. Called and to my surprise spoke directly to him. He explained what options he felt I had and what he felt he could do for my particular case. He is a man of his word and it all played out exactly as he had explained it to me. My charge of reckless driving was lowered, and the amount of the fine was as well. Most importantly to me, there is nothing on my driving record to indicate my careless mistake. Thank you, Mr. Mattox for your help and expertise.

Successful Reduction of Offense

Trey was able to appear in court on my behalf and successfully reduce my speeding infraction to a defective equipment charge. He responded quickly to emails and seemed on top of his game. I noticed his prices seem to be a bit higher than other attorneys in the area, but in my opinion the increase in charge is worth it.
